Bankruptcy laws in the States are governed by the <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/11\" target=\"_blank\" rel=\"noopener\"><strong>Code of Laws<\/strong><\/a> of the United States of America (USA). The Code has many sections, called Titles, and within various Titles are Chapters.<\/p><p><em>Whenever bankruptcy information refers to \u201cChapters,\u201d it is almost certainly American. In the States lawyers are often referred to as attorneys.&nbsp;<\/em><\/p> <h2>Canadian Bankruptcy versus American Bankruptcy Information<\/h2><p>To help you figure out if you\u2019re reading <a href=\"https:\/\/nomoredebts.org\/bankruptcy-canada\" target=\"_blank\" rel=\"noopener\"><strong>Canadian bankruptcy<\/strong><\/a> or <strong>American bankruptcy<\/strong>&nbsp;information, here are some of the most frequently used terms in the States:<\/p><p><strong><a name=\"chapter-7\" id=\"chapter-7\"><\/a>Chapter 7<\/strong> is the most common type of personal bankruptcy in the United States. Some businesses also file for Chapter 7. The name \u201cChapter 7\u201d does not apply to personal or business bankruptcies in Canada.<\/p><p><strong><a name=\"chapter-11\" id=\"chapter-11\"><\/a>Chapter 11<\/strong> is also part of the American bankruptcy system and the term \u201cChapter 11\u201d does not apply to <a href=\"https:\/\/nomoredebts.org\/blog\/bankruptcy\/better-debt-help-options-than-bankruptcy-in-canada\"><span style=\"color: #666666;\">bankruptcies in Canada<\/span><\/a>. A Chapter 11 petition is usually used by businesses and corporations, however some individuals with high debt loads also file a Chapter 11 bankruptcy. Chapter 11 includes a restructuring process, giving a business or individual time to get their financial affairs back in order.<\/p><p><strong><a name=\"chapter-13\" id=\"chapter-13\"><\/a>Chapter 13<\/strong> is the American equivalent to a Canadian <a href=\"https:\/\/nomoredebts.org\/debt-help\/debt-consolidation\/file-a-consumer-proposal\">Consumer Proposal<\/a>. In Canada, a Consumer Proposal is administered by a <a href=\"https:\/\/nomoredebts.org\/debt-help\/bankruptcy\/bankruptcy-definitions-glossary\/what-is-a-bankruptcy-trustee-debtor-creditor\" target=\"_blank\" rel=\"noopener\">bankruptcy trustee<\/a> and the process is governed by the <em>Bankruptcy and Insolvency Act<\/em>. It is, however, not the same as going bankrupt.
